The most common are such factors as the breadth of discretionary powers and the definition of competence according to the "may" formula.
Today the Ministry of Justice of the Republic of Tatarstan hosted an off-site meeting of the Committee of the State Council of the Republic of Tatarstan on Legality and Law and Order with the participation of members of the Expert Council.
The agenda of the Committee meeting included 3 issues. Rustem Zagidullin, Minister of Justice of the Republic of Tatarstan, made a speech on the key issue of anti-corruption examination of normative legal acts and their drafts in the republican executive authorities and local self-government bodies.
According to the Minister, for 9 months of 2023 the Ministry conducted legal and anti-corruption expertise of 2445 draft normative legal acts of the Republic of Tatarstan, of which the largest number of 2200 are draft resolutions of the Cabinet of Ministers of the Republic of Tatarstan.
"Compared to the same period of 2022, the number of projects in which corruption factors were identified has decreased. Of the projects received for examination in 9 months of 2023, 10 corruption risk factors were identified in nine of them. In 9 months of 2022, 16 corruption factors were identified in 12 projects," he emphasized.
The most frequently identified corruption risk factors during the anti-corruption examination are such corruption factors as the breadth of discretionary powers and the definition of competence by the "may" formula.
Rustem Zagidullin gave several examples identified by the Ministry. The breadth of discretion is the absence or uncertainty of terms, conditions or grounds for decision-making, the draft states: "The subsidy recipient shall submit to the Ministry: ... after three years following the year of receipt of the subsidy an extract from the Unified State Register of Real Estate on the main characteristics and registered rights, issued not earlier than 30 calendar days in advance, for the subsidized object".
"In this example, the corruption risk lies in the fact that the date on which the extract should be issued is uncertain in terms of the absence of the beginning of the countdown period," he explained.
In addition to the legal and anti-corruption expertise of draft regulatory legal acts, which was carried out, the Ministry also summarizes the statistics of anti-corruption expertise of acts and their drafts carried out by the republican executive authorities.
For 9 months of 2023, the republican executive authorities conducted anti-corruption expertise of 1906 drafts and 330 normative legal acts. 15 corruption factors were identified in 5 projects. For comparison, last year for the same period 48 factors were identified in 25 projects.
In conclusion, the Minister noted that improving the quality of development of normative legal acts is a priority activity of all public authorities, which contributes to the development of social relations and the welfare of the state.
