On changes in the legislation on personal information
As of September 1, 2022, amendments to the Federal Law of July 27, 2006 No. 152-FZ "On Personal Data" came into force. Operators must notify Roskomnadzor of the commencement or implementation of any processing of personal data, except in cases provided for in part 2 of Article 22 of the Federal Law of July 27, 2006 No. 152-FZ "On Personal Data", when the data is processed for the protection of state security and public order, transport security, or if the operator processes the data exclusively without means of automation.
The new notification forms are approved by Roskomnadzor Order No. 180 dated 28.10.2022 "On Approval of Notification Forms on Intent to Process Personal Data, on Change of Information Contained in the Notification on Intent to Process Personal Data, on Termination of Personal Data Processing".
The Personal Data Portal of Roskomnadzor (https://pd.rkn.gov.ru/operators-registry/notification/form/) has a functionality that allows the operator to form and send a notification to the territorial body of Roskomnadzor in one of the following ways:
1) in paper form;
2) electronically using an enhanced qualified electronic signature;
3) electronically using the ESIA authentication means.
Also, operators who sent a notification in the form in force until 26.12.2022 or who have changes in previously submitted information may send a notification of changes in the information (https://pd.rkn.gov.ru/operators-registry/notification/updateform/) to the previously submitted information to the Register of operators processing personal data.
Also, Roskomnadzor informs that the federal law does not specify the deadline for notifying Roskomnadzor about the processing of personal data, as well as about changes in the information specified in this notification.
