An elderly woman, a group 2 disabled person, applied to the State Legal Bureau of Tatarstan and asked to return the money she had lent to a friend.
The woman explained that her friend had borrowed the money on a receipt with a repayment term of 3 months. After the time expired, the friend did not return the money, did not contact her, and did not take measures to repay the debt.
In accordance with paragraph 1 of Article 810 of the Civil Code of the Russian Federation, the borrower is obliged to return the loaned money to the lender in the terms determined by the parties. In addition, according to Article 811 of the Civil Code, it follows that in cases where the borrower does not return the loan amount on time, interest is payable on it.
"We studied the documents and prepared a statement of claim to the court to recover from the defendant the amount of the debt in the amount of 150 thousand rubles, as well as interest for the use of funds. The court ruled to satisfy the applicant's claims," said Marat Sharafutdinov, Chief Specialist of the State Legal Bureau.
