Lawyers of the State Legal Bureau of Tatarstan provided assistance to a single mother raising a disabled child

The mother of a disabled child appealed to the State Bureau of the Republic of Tatarstan. The woman explained that in 2019 she was hired in one of the state institutions of the republic.

In 2022, she received an SMS notification from her employer on her phone that the employment contract with her had been terminated due to the admission of another employee. However, she was not informed of the dismissal order.

Employees of the State Legal Bureau explain that, in accordance with article 261 of the Labor Code of the Russian Federation, termination of an employment contract with a single mother raising a disabled child under the age of eighteen is not allowed at the initiative of the employer.

In addition, according to Article 84.1 of the Labor Code of the Russian Federation, the termination of an employment contract is formalized by an order of the employer. The employee must be acquainted with the employer's order on termination of the employment contract under signature.

Employees of the State Legal Bureau of the Republic of Tatarstan studied the documents, prepared a statement of claim to the court about violations of labor legislation.

«According to the results of the consideration of the application, the claims were partially satisfied. In favor of the applicant, the amount of average earnings during forced absenteeism in the amount of more than 300,000 rubles was collected from the employer, as well as compensation for moral damage in the amount of 5,000 rubles», - said Marat Sharafutdinov, chief specialist of the State Legal Bureau.
