Lawyers of the State Legal Bureau of the Republic of Tatarstan continue to provide free legal assistance to the participants of the SMO and their families
From the very first days in the republic, participants in a special military operation and their family members have been provided with comprehensive assistance, including in the legal field. The State Bureau of Defense of Tatarstan actively cooperates with the branch of the State Fund for Support of participants in the special military operation «Defenders of the Fatherland» in the Republic of Tatarstan. Every week on Thursdays, representatives of the State Legal Bureau of the Republic of Tatarstan hold a reception for citizens at the Foundation's site.
So, the deputy head of the State Legal Bureau of the Republic of Tatarstan, Rafael Giniatullov, was approached by the mother of the deceased participant of the SMO on the issue of recognizing the father of the deceased serviceman as an unworthy heir.
When communicating with the applicant, it turned out that on November 1, 2023, her son died while participating in a special military operation. In connection with this fact, the spouse and parents of the deceased are entitled to receive insurance and lump sum payments.
It also turned out that the father of the deceased left the family when his son was 3 years old, did not take any part in his life, did not keep in touch. Based on this, the mother of the deceased asked for help in writing a statement of claim to the court.
«Having studied the documents, I drafted a statement of claim for recognition of the right to pay the due share of social support measures — a one-time allowance provided for by Federal Law № 306-FL dated 07.11.2011; payments established by Decree of the President of the Russian Federation № 98 dated 05.03.2022; insurance amount, payments established by Decree of the Rais of the Republic of Tatarstan dated 04.04.2022 № PD-233, survivor's pension and monthly compensation with the deprivation of these payments and the obligation not to pay them to the father of the deceased participant of the SMO», - Rafael Giniatullov said.
The court's decision satisfied the claim. The woman expressed her gratitude for the help.
