Amendments to the Civil Procedure Code will come into force on September 1, 2024. The amendments will include the rules for filing an application for a court order, the time limits for issuing it by justices of the peace, and audio recording.
Starting from September 1, when filing an application with a justice of the peace, applicants must attach a document confirming payment of the state fee and a notice of delivery or other documents confirming that the claimant has sent a copy of the application to the debtor.
According to Yulia Mikhailova, a leading specialist in the department of organizational and legal support for justices of the peace of the Ministry of Justice of the Republic of Tatarstan, this change is aimed at protecting the rights of the debtor. It allows the debtor to avoid unfounded demands from the claimant, especially if the debtor did not participate in the trial.
The period allotted to a justice of the peace to issue a court order will double: if today it is 5 working days, then from September 1 it will increase to 10. The start of the calculation of the period will not change - it will still be counted from the date of receipt of the application to the court.
The changes also affected the recording of hearings. Now audio recording will not be conducted in closed hearings if the participants in the case did not appear or if a decision was made to perform a separate procedural action without notifying them.
The maximum period for drawing up a reasoned court decision will increase from 5 to 10 days. The court will be required to indicate the date of the decision at all stages of the trial. This will help make the trial more transparent and understandable for all participants, and will also help reduce the burden on the courts and improve the quality of document preparation.
The Ministry of Justice of Tatarstan reminds that residents of the republic and organizations can file claims, complaints, petitions and other procedural documents electronically through the Portal of Justices of the Peace of the Republic of Tatarstan.
