A civil case on a dispute on the protection of consumer rights was considered at the court station № 5 of the Sovetsky district of Kazan.
The plaintiff was a citizen who purchased 62 items from a clothing store under the «1+1» promotion.
According to the terms of the promotion, 31 goods were paid at full price, and the remaining 31 goods - for a symbolic 1 ruble.
The goods that cost 1 ruble suited the customer, unlike the one that was bought for full price. The plaintiff decided to return the goods and demanded a refund.
However, the justice of the peace refused to satisfy the claims, considering the plaintiff's actions to be an abuse of right.
In its decision, the court found no evidence of bad faith of the store in the disputed legal relationship and the promotion «1+1», considering the plaintiff's actions as evidence of the intention to use the terms of the action to circumvent its essence.
The appeal instance supported this position, leaving the court's decision unchanged.
