New in the legislation about local government

On the law of the Republic of Tatarstan on investment of local governments of municipal districts by state powers to gather information on the settlements, required for the conduction of the municipal register of regulatory legal acts of the Republic of Tatarstan

On 1st of January, 2016, the Law of the Republic of Tatarstan on 3rd of November, 2015 № 92-ZRT "On granting local authorities of municipal districts of the Republic of Tatarstan by state powers of the Republic of Tatarstan for the collection of information from the settlements within the municipal district needed to conduct the register of municipal regulations legal acts of the Republic of Tatarstan "(hereinafter - the Law) became effected.

According to the Law of the local authorities of municipal districts are required to submit to the Ministry of justice of the Republic of Tatarstan the following information on municipal normative legal acts of local governments of settlements (hereinafter - MNLA):

numbers and dates of registration MNLA;

MNLA details (type of act and adopted the name of its authority, the date of adoption (signing) of the act, its number and name);

details furnished in the form of legal acts of the decisions taken at the local referendum (the gathering of citizens) (type of act, the date and venue of the local referendum (the gathering of citizens), the date of execution of the act, its number and name);

information about the source of the official publication (promulgation);

 

texts as published (promulgated), as unpublished (unpromulgated) acts;

 

acts of prosecutorial response taken against MNLA (submission of protests and statements in court);

 

judicial acts for contesting MNLA;

 

the statutes and judgments of the Constitutional court of the Republic of Tatarstan for the verification of compliance MNLA of the Constitution of the Republic of Tatarstan;

charge of antimonopoly bodies, addressed to local authorities, about the abolition or amendment of acts adopted by them, contrary to federal law;

acts of state authorities to cancel or suspend of the activity the MNLA in the part regulating the exercise by local self-government of specific state powers transferred to them by federal laws and laws of the Republic of Tatarstan;

demands, letters, other information received from the prosecution bodies, and also letters and other information received from the public authorities of the Republic of Tatarstan, other state agencies and local governments.

Local governments of municipal districts are required to identify the officials responsible for the collection of the above information on settlements, carry written instructions of state authorities of the Republic of Tatarstan to eliminate violations of the law, provide quarterly reports on the implementation of state powers, to provide the necessary assistance to the public authorities of the Republic of Tatarstan in monitoring the implementation of the transferred state powers.

The report on the implementation of state powers submitted to the Ministry of justice of the Republic of Tatarstan in the form approved by the Cabinet of Ministers of the Republic of Tatarstan from 17.12.2015 № 2967-p, which is available on the ministry's website (www.minjust.tatarstan.ru, see "Direction of activity", subsection "Register of municipal normative legal acts of the Republic of Tatarstan", tab "Legislative and other normative legal acts on keeping the register of municipal normative legal acts of the Republic of Tatarstan").

Ministry of justice of the Republic of Tatarstan developed exemplary acts for the organization of interaction of bodies of local self-government of the municipal district and its member communities on the question of collecting and sending documents to the register of municipal normative legal acts of the Republic of Tatarstan, which are posted on the ministry's website (see "Direction of activity”, subsection " Local self-government ", tab" Approximate normative legal acts of local self-government ").
