Which way of inheritance is more reliable? Lawyers answered these and other questions of Kazan residents

In honor of the Day of the Republic of Tatarstan, a day of free legal
assistance was held in Kazan. Consultations were conducted by lawyers of the State Legal Bureau of Tatarstan, attorneys, notaries, representatives of relevant departments and supervisory bodies.

 

Most often, Kazan residents raised topics related to the appointment and registration of pensions, issues regarding land plots, payment of housing and communal services, division of property and alimony.

 

One of the pressing topics was inheritance law. An elderly woman approached lawyer Guzel Sultanova with a question about transferring inherited property to relatives.

 

«If a deed of gift is drawn up, the donor loses the right of ownership during his lifetime, and the donee becomes the owner. In this case, there is a certain risk, —  warned Guzel Sultanova. —  There are cases when the subject of the gift is housing and, if relations deteriorate within the family, the donees end up deregistering the donor and evicting him from the living space. It will be extremely difficult to get your home back through the court».

 

According to the lawyer, a will also has its nuances: it can be rewritten at any time, and this can also lead to undesirable consequences. There are now enough cases related to fraud, when a will is fraudulently rewritten in favor of strangers.

 

According to Guzel Ravilevna, the optimal solution is often a lifelong maintenance contract with dependency —  then the recipient undertakes to take care of the owner, and if the conditions are not met, the contract can be terminated.

 

«In this case, a citizen transfers ownership of his apartment, and the new owner undertakes to support him. The contract specifies specific obligations: for example, a monthly payment of a certain amount, the purchase of medicines, food, etc. If the conditions are not met, the former owner can go to court with a demand to terminate the contract», — Guzel Sultanova emphasized.

 

In total, 25 people sought free legal assistance on 29 issues during the reception. The Ministry of Justice of the Republic of Tatarstan expresses gratitude to all participants of the event for their joint work!
