A pensioner from Tatarstan was able to return more than a million rubles for the purchased house of inadequate quality thanks to free legal assistance from an employee of the Ministry of Justice of the Republic.
The elderly woman turned to Darya Bekmansurova, the head of the department of interaction with the republican executive authorities on insolvency (bankruptcy) at the Ministry of Justice of Tatarstan, with a problem that has not been resolved for two years. A pensioner bought a plot of land with a house, which turned out to be unsuitable for living. When she tried to cancel the sales contract, the seller refused to comply and subsequently initiated his own bankruptcy proceedings.
The case went through several court instances: after dismissal decisions in the court of first instance and in the court of appeal, the decision of the judicial panel on civil cases in the Sixth court of cassation, the decision of the general jurisdiction in the court of first instance was canceled and the case was sent for a new trial. During the re-examination by the court of the first instance, a refusal was also followed, which required the preparation of a new appeal.
«When analyzing the numerous documents provided by the pensioner, we found a key element for her protection - an examination confirming the unacceptable technical condition of the purchased building. I recommended her to request that the attention of the court be drawn to the presence of this important document in the case file, so that the court would consider this fact and pay attention to the unfair nature of the transaction from the beginning», - explained Darya Bekmansurova.
During these proceedings, it was found that the disputed property was put up for sale as part of the bankruptcy procedure to the seller. As a result of competent legal support, the court ruled in favor of the pensioner, and the woman received the entire amount of the purchase - more than a million rubles. Currently, with the assistance of Darya Igorevna, a pensioner has filed an application and will seek compensation.
