A meeting of the working group of the Interdepartmental coordinating committee on legal issues was held at the Ministry of justice of the Republic of Tatarstan. The key topic of discussion was the initiative to revise the upper limit of the amount of administrative fines imposed on citizens for offenses provided for by regional laws. During the meeting, it was noted that the Legislative Assembly of St. Petersburg is already preparing a corresponding draft federal law aimed at increasing the maximum amount of monetary penalties for violators.
The members of the working group noted that the current maximum administrative fine of 5 000 rubles was established by federal law back in 2007 and has not been revised since that time.
«The existing limitation on the amount of an administrative fine for citizens today does not allow in some cases to effectively achieve the goals of administrative punishment and does not correspond to current economic realities», - the participants of the meeting emphasized.
According to experts, administrative punishment should not only express a negative assessment of the committed act by the state, but also perform a preventive function.
«According to part 1 of article 3.1 of the Codex of administrative offences of the Russian Federation, administrative punishment is applied in order to prevent the commission of new offences both by the offender himself and by other persons. However, the existing restrictions do not provide a proper preventive effect», - the meeting said.
During the discussion, economic indicators were presented that demonstrate a significant increase in household incomes in recent years.
«It should be borne in mind that since the introduction of this restriction, the real incomes of the population have increased many times. If in 2007 the average salary in Russia was 13 518 rubles, then in 2024 this figure has already reached 83 656 rubles», - the members of the working group said.
Following the meeting, it was decided that it was necessary to adjust the upper limit of administrative fines in order to bring them in line with modern economic realities and ensure efficiency in solving crime prevention tasks.
