The Ministry of justice of Tatarstan explained to citizens the issues of publishing court proceedings

he Ministry of justice of the Republic of Tatarstan draws the attention of residents of the republic to the inevitability of publishing information about court proceedings involving them on official information resources.

 

In accordance with Federal law № 262-FZ dated december 22, 2008 «On providing access to information on the activities of courts in the Russian Federation» and Resolution № 35 of the Plenum of the Supreme Court of the Russian Federation dated december 13, 2012, information on cases considered by justices of the peace is subject to mandatory posting on the Official portal of justices of the peace of the Republic of Tatarstan. At the same time, court orders are not publicly available, since they do not relate to judicial acts that are subject to mandatory posting on the Internet in accordance with article 15 of the said federal law.

 

Yulia Mikhailova, head of the department of organizational and legal support for the activities of magistrates, explained: «The registration numbers of cases, their names, the subject of the dispute, information about the participants in the process and information about the issuance of judicial acts are published on the Portal. This information is available to all citizens».

 

According to her, there are only a limited number of exceptions to the general rule: «Judicial acts containing information concerning state security, family and legal relations, the rights of minors, as well as decisions on hospitalization are not subject to publication», - Yulia Mikhailova clarified.

 

It is important to note that the published information about court cases is not subject to deletion and is stored in the Portal's electronic archive indefinitely. The Ministry does not have the legal capacity to act selectively when posting information about court proceedings.

 

«We receive requests and even threats demanding that information about certain court cases be deleted when people are afraid that their surroundings will find out about their offenses. However, the agency operates strictly within the law and has no right to violate it», - the Ministry of justice emphasized.

 

The Ministry of justice of Tatarstan urges citizens of the republic to be aware of the possible consequences of violations of the law, including the inevitability of publicity of the trial.
