Tatarstan Ministry of Justice: Taking a microloan from a relative's phone without permission is a criminal offense

The magistrate of judicial district № 6 of the Kirov judicial district of the city of Kazan has completed the consideration of a criminal case related to the theft of funds using a mobile phone. A resident of Kazan was in the dock, who, without his brother's knowledge, used his mobile device to obtain microloans.

«Recently, the number of cases of theft of electronic funds using mobile phones has increased significantly. There are often situations when a close relative becomes a criminal - shares a 2nd category specialist - head of the office of the judicial district Valeria Maryanina. But the law makes no exceptions for such situations - theft committed by a close person is legally equivalent to any other theft».

According to the case materials, the defendant was found guilty of committing crimes under part 1 of Article 159 of the Criminal Code of the Russian Federation. This article provides for liability for theft of someone else's property or acquisition of rights to it by deception or abuse of trust.

Thus, the damage amounted to 98,650 rubles. This material damage was compensated by the defendants before the trial.

Based on part 2 of Article 69 of the Criminal Code of the Russian Federation for a combination of crimes by partial addition of the assigned punishments, the court sentenced the perpetrator to a fine of 50 000 rubles.
