Ministry of Justice of Tatarstan: it is impossible to transfer a child to a remedial class without parental consent

It is illegal to transfer a child to a remedial class or specialized educational institution without parental consent.

This issue was raised at the reception of citizens in the regional public reception room of the United Russia party, timed to coincide with the International Children's Day. Yaroslav Shvets, head of the department of organization of free legal aid and planning of the Ministry of Justice, was approached by a Kazan resident concerned about the possibility of such a transfer without her consent.

«On its own, without the consent of parents, the teaching staff cannot change the form of education of a child. Such actions directly contradict the Federal Law “On Education in the Russian Federation», - he explained.

According to Yaroslav Shvets, even in the presence of the conclusion of the psychological-medical-pedagogical commission (PMPK), recommending special education, the last word remains with the parents or legal representatives of the child. The conclusion of the commission is only of a recommendatory nature and cannot be the basis for forced transfer. «If such an offer from school specialists is received, it is important for parents/legal representatives to understand what it is related to before refusing. And to act based on the interests of their child», - he added.

A total of 6 people applied for free legal consultations. The main questions concerned the procedures for restoring parental rights, guardianship, effective use of maternity capital, child support payments, alimony collection and social guarantees for large families.
