Does a court have the right to post information about court cases on the Internet? The Ministry of Justice of Tatarstan explains

The Ministry of Justice of the Republic of Tatarstan has received an increasing number of appeals from residents of the republic regarding the publication of information about court decisions and participants in court proceedings on the Internet.

Yulia Mikhailova, Acting Head of the Department of Organizational and Legal Support of Magistrates' Activity of the Ministry, explains that in accordance with the requirements of the Federal Law № 262-FL dated December 22, 2008 «On Ensuring Access to Information on the Activities of Courts in the Russian Federation», judicial acts must be published on the official website of the relevant court, in the Republic of Tatarstan it is the Portal of Magistrates.

On September 27, 2017, the Presidium of the Supreme Court of the Russian Federation established the procedure for posting the texts of judicial acts on the official websites of the courts. The ruling lists the personal information that is not to be excluded from a judicial act posted in the public domain.

«In particular, the registration numbers of cases, their names or the subject of the dispute, information about the participants in the judicial process, information about the passage of cases in court, as well as information about the issuance of judicial acts on the results of consideration of cases should be preserved», - says Julia Alexandrovna.

In addition, it is specified which court decisions are not subject to publication: acts issued in cases affecting the security of the state, arising from family law relations, on compulsory hospitalization in a psychiatric hospital.

«In other cases, the published information on court cases on the Portal of Justices of the Peace of the Republic of Tatarstan is not subject to deletion and is stored in the electronic archive of the Portal», - she summarized.
