Yesterday, on January 31, 2013, at a session of the State Council, was adopted the Law of the Republic of Tatarstan "On Amendments to the Law of the Republic of Tatarstan" on allotment of local government municipality of Kazan, Tatarstan state powers to determine the list of officers authorized to draw up reports on administrative violations. The draft law was presented by Minister of Justice M.M.Kurmanov.
In his speech, he told that the initial right of protocols on administrative violations had environmental police officers, but after the elimination of environmental police these powers were left hanging in the air. An exception was made in the country only for Kazan - the capital since 2010 is working administrative technical inspection. Under the bill, the state authority to determine the list of officials authorized to draw up reports on administrative offenses, will be endowed with all municipal and urban districts of the republic. If until now the penalties for violating the rules of improvement received to the budget of the Republic of Tatarstan, now in accordance with the Decree of the President of the Russian Federation on May 7, 2012 in connection with the improvement of management, these fines from January 1, 2013 in its entirety should go to municipal budgets.
Now, with a single violation within a year of individuals can be punished by a fine of 2 to 5 thousand, officials - from 15 to 30 thousand rubles, legal entities - from 200 to 500 rubles. Repeated violations of a fine on the organization can reach 1 million.
In the past year in Kazan was imposed fines of 138 million rubles, in fact collected 85 million rubles.
Vesting of all municipalities of the Republic of Tatarstan power to appoint persons authorized to draw up reports on administrative offenses, has caused a number of questions of the deputies.
The new law gives local governments a privilege, which so far is only used in the capital: self-monitor compliance improvement in their territory. Structures like Kazan manage administrative and technical inspection will soon appear in all areas. First, it is a powerful tool of pressure on business: strip the fine for uncollected garbage or unpeeled roof reaches 1 million. Second, there is a financial incentive: the entire collection will go to the local budget.
To remove all questions of MPs, the Ministry of Justice, Ministry of Finance and the Council of Municipalities of the Republic of Tajikistan will have to compile a list of the officers of municipal officials who were granted the right to draw up reports on administrative offenses. So as a result, the bill was passed in three readings.
