The Minister of Justice M.M.Kurmanov presented three legislative drafts at the meeting of the State Council of the Republic of Tatarstan

Today at the session of the State Council of the Republic of Tatarstan the Minister of Justice M.M.Kurmanov presented three legislative drafts. In particular, "On Introducing Amendments to Law of the Republic of Tatarstan" On establishment of Judicial Districts and posts of Justices of the Peace in the Republic of Tatarstan ", aimed at bringing the law of the Republic of Tatarstan in compliance with federal Legislation.
By the Federal Legislation of November 12, 2012 № 184-FL "On Amendments to Article 1 of the Federal Law "On the total number of justices of the peace and judicial districts in the Russian Federation ", there are introduced modifications to the paragraph 1 of the Federal Legislation " On the Total Number of Justices of the Peace and the number of judicial districts in the Russian Federation "in terms of increasing the number of justices of the peace and, therefore, the number of judicial districts by six units, from 182 till 188.
Enactment of the Federal Legislation requires the introducing amendments to the Law of the Republic of Tatarstan "On establishment of judicial districts and Justices of the Peace in the Republic of Tatarstan". The Minister of Justice announced the way how six units of Justices of the Peace allocated to Tatarstan will be distributed, in particular, the number of justices of the peace will increase by one in Vakhitovsky, Privolzhsky, New Savinovskiy, Soviet districts of Kazan and by two in Naberezhnye Chelny. Thus, later the question regarding the boundaries judicial districts will be discussed. This legislative draft was adopted by deputies in the first reading and as a whole.
Today, at a meeting of the State Council at the first and the third readings law "On introducing amendments to the paragraph 35 of the Law of the Republic of Tatarstan "On Municipal Service in the Republic of Tatarstan ", concerning the qualification requirements for managers (secretaries) of the executive committees of municipalities on the mandatory presence of higher education was accepted.
It should be reminded that till on the January 1, 2013 the transitional provisions of the above Law operated, which allowed only vocational education for the posts of Deputy Head (Secretary) of the rural settlement.
The legislative draft aft law was submitted by the Government of the Republic in execution of commission of an order of the President of the Republic of Tatarstan. It provides extension of the period of action of transitional provisions of this law till January 1, 2018. The Minister of Justice also submitted the legislative draft of the Republic of Tatarstan " On Amendments to Article 13.2. The code of the Republic of Tatarstan about administrative offenses", directed on ensuring ordering of implementation of retail trade in non-stationary trade objects as a whole. Existing administrative penalties for the specified offenses are insufficient for prevention of the consequences coming owing to violation of demands, made for legal implementation of retail trade.
For example, only by the Office of Administrative and technical inspection of Executive committee of Kazan to administrative responsibility under article 3.2. The code of the Republic of Tatarstan about administrative offenses it was attracted: in 2010 - 14 individuals; in 2011 - 8 legal entities, 18 officials, 455 - individuals; as of 26.10.2012 - 21 official and 766 individuals.
According to the municipal land control of Kazan in 2010, recorded 934 facts of unauthorized installation of unsteady retail facilities; 2011 - 817 since the beginning of 2012 this figure had reached 1,786 objects.
The main causes of the violation of the Code of the Republic of Tatarstan on administrative violations are the following factors: unwillingness of businessmen to arrange documents to land to accommodate transient object of trade; lack of administrative responsibility under Article 7.1 of the Code of Administrative Violations; legal nihilism.
There are the following changes for violation of the organization of street trade are expected by this legislative draft: trade in unauthorized places for these purposes shall entail a warning or the imposition of an administrative fine on citizens in the amount of one thousand to five thousand rubles for officials - from four to ten thousand rubles for legal persons - from fifteen thousand to one hundred and fifty thousand.
The deputies passed legislative draft in the first reading.
The Minister of Justice M.M.Kurmanov informed deputies on the implementation of the protocol instructions of the State Council of Tatarstan 31.01.2013 on the implementation of the Law of the Republic of Tatarstan from 30.06.2010. № 60 law of RT "On allotment state powers of local government municipalities in the Republic of Tatarstan to determine the list of officials authorized to draw up reports on administrative offenses."
It will be recalled that at the last session of the State Council, 31 January 2013., The Law of the Republic of Tatarstan "On Amendments to the Law of the Republic of Tatarstan" On allotment state powers of local government municipality of Kazan by state powers of Tatarstan to determine the list of officials authorized to draw up reports on administrative offenses. The new law gives local governments of municipalities and municipal districts of public authority to determine the list of officials authorized to draw up reports on administrative violations, which caused some questions.
