The Tatarstan Prosecutor's Office held a training and methodological seminar on the implementation of legislation on state civil and municipal service and combating corruption. A representative of the Tatarstan Ministry of Justice made a report to employees of city and district prosecutor's offices and equivalent specialized prosecutor's offices.
Leading Advisor of the Department of Legal Expertise and Rulemaking Activities of the Tatarstan Ministry of Justice Liliya Muradymova explained the procedure and methodology for conducting anti-corruption expertise of regulatory legal acts and their drafts.
According to the leading advisor, anti-corruption expertise, in accordance with Federal Law № 172-FZ, is a special legal audit aimed at identifying and eliminating corruption-causing factors in regulatory legal acts and drafts of regulatory legal acts.
«For example, in regulatory acts, it is unacceptable to replace terms indicating the obligation of actions («implements», «considers») with formulations indicating only the possibility of such actions («has the right», «may»). Such a substitution creates grounds for the arbitrary application of norms and can lead to corruption», - she explained.
During her speech, Liliya Muradymova answered practical questions from the prosecutor's office employees. They were especially interested in specific cases from the practice of examining municipal legal acts and algorithms for identifying hidden corruption factors in documents with a complex legal structure.
To improve the effectiveness of this work, the Ministry of Justice of the Republic of Tatarstan has developed practical recommendations for conducting anti-corruption examination. When determining the normative nature of acts, the specialist recommended being guided by the resolutions of the Plenum of the Supreme Court of the Russian Federation and the methodological materials of the Ministry of Justice of Russia.
The seminar was held as part of planned events to improve the qualifications of employees of the prosecutor's office of the Republic of Tatarstan.
