Lawyers of the State Law Bureau of Tatarstan defended the housing rights of the family of a SMO participant
In Tatarstan, free legal assistance is provided to military personnel and their family members on a permanent basis and is part of the comprehensive support for participants in the special military operation, which is being implemented on behalf of the Rais of the Republic of Tatarstan Rustam Minnikhanov.
The spouse of a participant in the special military operation who died in the area of the special military operation applied to the State Legal Bureau of the Republic for free legal assistance.
As the soldier's spouse reported, her husband had previously been provided with housing as an orphan or child left without parental care. After the death of the soldier, a legal problem arose - his spouse and their common child could not continue to live in the housing provided to him from a specialized fund under the current agreement.
«According to the law, minor children and spouses can be moved into residential premises provided to orphans. In the event of the death of the tenant, the authorized body is obliged to exclude the premises from the specialized housing stock and conclude a social rental agreement for this housing with the family members of the deceased», - explained Deputy Head of the State Legal Bureau of the Republic of Tatarstan Rafael Ginniatulov.
The lawyers of the State Legal Bureau prepared a statement of claim, which was accompanied by the necessary evidence of the rights of the wife and child of the serviceman. The court considered the case and made a positive decision: the claim was satisfied, the wife and their common child were officially recognized as family members, and the authorized body was ordered to conclude a social rental agreement for the apartment.
